AGREEMENT BETWEEN THE REPUBLIC OF KOREA AND JAPAN CONCERNING LEGAL STATUS AND TREATMENT OF NATIONALS OF THE REPUBLIC OF KOREA RESIDING IN JAPAN
The Republic of Korea and Japan,
Considering that nationals of the Republic of Korea residing in Japan for many years have maintained special and close relations with the ▣...▣ ofsocial commission of Japan,
Recognizing that ▣...▣to ▣...▣ such nationals of the Republic of Korea to enjoy a stable life under the ▣...▣▣...▣ order of▣...▣ Japan would contribute to the promotion of the friendly relations between them and their peoples,
Have agreed as follows:
Article 1
1. When nationals of the Republic of Korea falling under either of the following sub-paragraphs make an application for permanent residence in Japan within five years after the entry into force of the present Agreement in accordance with the procedures to be determined (by the Government of Japan) for the implementation of the present Agreement, the Government of Japan shall permit them to reside permanently in Japan;
(a) Who have been residing continuously in Japan since, before(August 15) 1945, and until by the time of the application; or
(b) Who has been born in Japan as lineal descendants of the persons referred to in the preceding sub-paragraph (a) within five years after the entry into force of the present Agreement since after (August 16) 1945, and have thereafter resided continously in Japan until by the time of the application.
2. When nationals of the Republic of Korea, born in Japan after the lapse of five years subsequent to the entry into force of the present Agreement as children of the persons permitted permanent residence in Japan under the provisions of the preceding paragraph 1, make an application for the permanent residence in Japan within sixty days from the date of their birth in accordance with the procedures to be determined by the Government of Japan for the implementation of the present Agreement, the Government of Japan shall permit them to reside permanently in Japan.
3. No fees shall be levied with respect to the application or the permission mentioned above.
Article 2
1. The Government of Japan have the readiness, upon the request of the Government of the Republic of Korea, to consult with the batter, until before the lapse of twenty-five years after the entry into force of the present Agreement, regarding the residence in Japan of nationals of the Republic of Korea who have been born in Japan as lineal descendants of the persons permitted permanent residence in Japan. under the provisions of Article 1.
2. In the consultation referred to in the preceding paragraph, the spirits and the purposes underlying the present Agreement shall be respected.
Article 3
A national of the Republic of Korea who has been permitted permanent residence in Japan under the provisions of Article 1 shall in no case be forced to deport from Japan except when, by his act committed after the entry into force of the present Agreement, he falls under any one of the persons referred to below:
(a) Who is sentenced to a penalty of not less than imprisonment for Crimes concerning Insurrection or Crimes concerning Foreign Troubles in Japan(excluded when sentenced to reprieve or to a penalty due to his blind participation in the Insurrection); or
(b) Who is sentenced to a penalty of not less than imprisonment for Crimes concerning Foreign Relations in Japan or to a penalty of not less than imprisonment for his criminal act against the head of foreign states or against diplomatic envoy or its premises, which consequently harms grave diplomatic interests of Japan; or
(c) Who is sentenced to penal servitude or imprisonment for life or for a period of not less than three years in violation of the narcotics control laws of Japan with the purpose of gaining profit(excluded when sentenced to reprieve), or sentenced to a penalty not less than three times (two times in case he had been punished not less than three times by the act committed before the entry into force of the present Agreement) in violation of the narcotic control laws of Japan; or
(d) Who is sentenced to penal servitude or imprisonment for life or for a period of exceeding secen years in violation of laws of Japan.
