Report of the Claims Committee to the Fourth Plenary Session

 

The Claims Committee held six sessions up to this date, concerning the problem of the disposition of property and claims, which is the 2nd item of five items of the agenda decided at the Plenary Session.
At the First Session the Korean side presented “Draft Principles of Agreement on Property Claims between the Republic of Korea and Japan,” and gave its explanations at the Second Session. The Korean side further submitted the times of the abovementioned draft principles at the Third Session, and questions and answers were exchanged between the Japanese and Korean Delegates at the Third and Fourth Session concerning the Korean draft and its items.
At the Fifth Session, the Japanese side presented, as a corresponding draft, “Basic Principles of Agreement to be concluded between Japan and the Republic of Korea concerning the Disposition of Property and Claims”, and gave its explanations. However, this was only part of the Japanese proposal, not the whole. Toward this, the Korean side expressed “Different Opinions of the Korean Side on the Japanese Proposal concerning the Problem of Claims.” Though the Japanese side stated that the questions and answers were to be made concerning the Japanese proposal, the Korean side replied that it deemed unnecessary to made questions, as there was a radical discrepancy in the legal opinions on the principal problems between both sides. At present, the discussion on the subject problem is at a standstill.
