4. In 1955, Japan finally started to detain at detention camps "undersirable" Koreans who have been residing in Japan since prior to World War II. These detainees numbered 484 as of December 31, 1957.
5. By the Agreement of December 31, 1957 signed by Korean Ambassadors Kim and Japanese Foreign Minister Fujiyama,
Japan released all those 484 Koreans in Japan. Furthermore, an understanding was reached on the same day (this was not released at that time) that Japan would refrain from detaining
them at its detention Camps in the expectation that the problem of legal status of Korean residents in Japan would be settled
at the 4th Korea -Japan talks.
6. Since the 4th Korea -Japan talks, the problem of
Koreans has been on agenda. Since the days of 1952 negotiation, one of the articles on which both sides agreed to discuss has been 'repatriation' of Koreans in Japan. During the foregoing months of negotiation, Japan probably thought that the theory of deportation in International law is not sufficient instrument for realizing mass repatriation of Koreans out of Japan : She did not mind destination of such
repatriation. She had in mind the Republic of Korea as destination of the above Korean repatriatees so long as she negotiates with the Republic of Korea Government. Now she found that Koreans could not be repatriated to the Republic of Korea through negotiation. Then she could not but devise another theory 'humanitarianism.
7. The Japanese thought as stated above let Japanese Foreign Minister Fujiyama, on January 30, 1959, his
determination to enforce the group repatriation to north Korea of Korean residents in Japan.
8. According to the Japanese argument, this question has nothing to do with politics and is nothing but humanitarian' consideration since a number of them wish to be repatriated to north Korea. Will any free people believe that it is humanitarian to drive people into communist slavery? If the Japanese approach is really from humanitarian consideration, how could it reach the decision so late?
9. As stated above, the Japanese Government signed the term that it would not detain Koreans any more without connetion. Will this term sanction Japan to send the people to the communist area instead of detaining them?
10. It is without doubt that aliens can leave foreign soil without hindrance in international law. This is not to say that any government can enforce a great scaled exodus of aliens without encroachment on normal relations with the Government to which they belong. This is not the case of exit permit to aliens. If it be so, will it be the subject for a
Foreign Minister's statement?
11. By the aforementioned Agreement of December 31, 1957, the Japanese Government was obligated to repatriate all Korean illegal entrants detained at its detention camps. However, at the meeting held on January : 27 1953 and subsequent meet—
ings, Japanese side ▣...▣ ▣...▣ ▣▣ ▣...▣1,▣...▣-s ;that those Koreans who
entered Japan after World War II and allegedly desire to go
to "north Korea " would never be sent to "north Korea ". Then we are at a loss to understand how the Japanese Government
reached a conclusion that it can send to north Korea those
Koreans who have resided in Japan since prior to the termination of World War II.
12. It is a firmly-established principle of inter
national law that a sovereign nation has the right, an one of its fundamental rights, to protect its nationals whether they are residing at home or abroad. As the only lawful Government in Korea, our Government in Korea, our Government naturally has the right as well as obligation to protect the Korean residents in Japan. To repatriate Korean nationals
to "north Korea " under the occupation of the communist puppet regime despite firm objection on the part of our Government is a clear indication that the Japanese Government is denying the fact that our Government is only lawful Government in Korea and constitutes in▣...▣ infringements upon our sovereign right.
13. Japanese Foreign Minister's ab▣▣pt announcement came just when the 4th Korea -Japan Conference was about to be resumed. This is tantamount to breaking off the Conference which is to settle various pendinghquestions between the two countries including the question of legal status of Korean residents in Japan. Such attitude on the part of the Japanese Government is an unmistakable evidence that the Japanese Government has no intention get along with us in settling
various pending questions at the conference. The Japanese contention that the question of the repatriation must be dealt with separately from the question of the Conference is a clear indication that the Japanese side is trying to shift
the responsibility of possible of the Conference to
our side. If the question could be dealt with separately from the question of the Conference, what would the Japanese
side like to discuss at the Committee of Legal Status of Korean Residents in Japan ?
14. The north Korean puppet regime is seriously suffering from shortage of manpower. To repatriate the Korean residents to "north Korea " is nothing but to help the
puppet regime reinforce its strength. This is tantamount to taking a hostile action against free world, especially, the United Nations Korean War Allies which fought alongside of us against the communist aggression.
