口 上 書 外務省 は,在本邦大韓民国代表部 に敬意を表するとともに,同代表部の1959年12月22日付口上書PKM-26に言及し,次のとおり申し述べる光栄を有する。
1. 日本国政府 が,大韓民国政府 に対して機会ある度に明らかにしたとおり,就中,去る12月18日山田外務事務次官が,大韓民国代表部 代表柳大使に手交したエード・メモアール において明らかにしたとおり,北鮮 帰還は,居住地選択の自由という基本的人権にかかわる人道問題であることは,洽ねく支持されており,またこの見地に基く日本国政府 の処理方針が正しいことは,客観的にも証明されている所である。
2. そもそも,自国民,特に他国への不法入国者が他国政府によって退去強制処分をうけた場合,これを速かに自国領域内に引取ることは,確立せる国際法上の原則である。それにも拘らず,大韓民国政府 は,在日韓人刑余者については1952年5月以後,また,韓人不法入国者については1954年7月以後,すみやかにこれを引取る措置を講じないために,日本国政府大村収容所 に収容しておくことを余儀なくされる韓人の数は増加する一方となり,また,その収容期間も著しく長期化するに至った。大村収容所 に収容されている韓人不法入国者の中に北朝鮮 帰還希望者が発生するに至ったのは大韓民国政府 が,確立せる国際法上の原則に従ってその責任を果さないところに起困するものであって,若し大韓民国政府 がすみやかに彼らを引取っておりさえすれば,かかる問題は全く発生する余地がなかったことは明らかである。
3. 本邦に密入国した後大村収容所 に収容され,日本国政府 当局の特別の配慮によってその後仮放免された韓人中の若干名が,自らの選択によって最近北朝鮮 へ帰還したことは事実である。しかしながら,彼等の帰還に関し韓国代表部が今回の口上書においてなした非難は,次の理由により根拠を欠くものである。
すなわち,1957年12月31日に署名された「日本国において収容されている韓人及び韓国において収容されている日本人漁夫に対する措置に関する日本国政府と大韓民国政府との間の了解覚書」 は,「大韓民国政府 は,第二次世界大戦後 の韓人不法入国者の送還を受け入れる」旨を規定しており,これによって明らかなように,右「了解覚書 」は,大韓民国政府 が韓人不法入国者を速かに引取るべき義務を同政府に課したものであるが,日本国政府 が韓人不法入国者の凡てを大韓民国政府 に引渡す義務を日本国政府 に課したものではない。この点は,不法入国者その他退去強制の事由に該当する外国人を強制送還することは,主権国の権利であって,義務ではないという国際法の原則から見て,論争の余地の無い当然のことであり,連絡委員会の会議その他の機会に日本 側が屢次指摘したとおりである。

NOTE VERBALEThe Ministry of Foreign Affairs presents its compliments to the Korean Mission and,with reference to the latter's note verbale PKM-26 dated December 22,1959,has the honour to state as follows:
1. As has been made clear by the Government of Japan to the Government of the Republic of Korea on every occasion,particularly in the aide memoire handed over by Mr. Hisanari Yamada, Vice Minister for Foreign Affairs,to Ambassador Tai Ha Yiu,Chief of the Korean Mission,on December 18,1959,it has been widely supported that the repatriation of Koreans to North Korea is a purely humanitarian problem based on the fundamental human rights regarding the freedom of choice of residence and,also,it has been objectively proved that the policy of the Government of Japan in dealing with this problem under such basic position is just and proper.
2. it is a firmly established principle of international law that a State is under obligation promptly to admit or re-admit its nationals into its own territory,particularly those who entered the territories of another State illegally and who are deported by the Government of the latter State. Nevertheless,the Government of the Republic of Korea not only failed,after May 1952,to take steps promptly to accept the deportation of Korean residents in Japan who bad committed crimes but also failed,after July 1954,to take steps to accept the deportation of Korean illegal entrants promptly,thereby compelling the Government of Japan to keep an ever increasing number of Koreans in the Omura immigration Center and consequently causing the prolongation of their internment to a considerable extent. It is solely due to this negligence on the part of the Government of the Republic of korea to carry out its own responsibility under the established principle of international law that an atmosphere developed among the Korean illegal entrants interned at the Omura Immigration Center in which some of them came to desire to return to North Korea. It is evident,therefore,that if the Korean Government had promptly accepted the deportation of Korean illegal entrants there would have been no room at all for any such problem as this to arise.
3. It is true that some of the korean illegal entrants into Japan who were interned at the Omura immigration Center and were later granted parole by special consideration of the Government of Japan,recently returned to North Korea by their own choice. However,the accusations made by the Korean Mission in this regard in its note verbals under reference cannot be justified for the following reasons:
The Memorandum of Understanding between the Government of Japan and the Government of the Republic of Korea regarding Measures on Koreans Detained in Japan and on Japanese Fishermen Detained in Korea,signed on December 31,1957,explicitly provides that "the Government of the Republic of Korea - will accept the deportation of Korean illegal entrants after the World WarII. From this provision it is evident that the said "Memorandum of Understanding,while imposing an obligation on the Government of the Republic of Korea to accept Korean illegal entrants promptly,imposes no obligation on the Government of Japan to deliver all Korean illegal entrants to the Government of the Republic of Korea. This is natural and indisputable in view of the principle of international las that it is a right but not duty of a sovereign State to deport illegal entrants of other aliens who are subject to deportation under its laws and regulations,It is added that the above position of the Japanese Government has been repeatedly clarified by the Japanese side at the meetings of the Working Committee as well as other occasions.
