AIDE MEMOIRE
With regard to the Korean proposal, made by Ambassador Yiu Tai Ha, Chief of the Korean Mission, orally to Mr. Hisanari Yamada, Vice Minister for Foreign Affairs, on December 11th, 1959 and also by the aide memoire handed to Mr. Yujiro-Iseki, Director of Asian Affairs Bureau, on December 14th, 1959, that the problem of the repatriation of Koreans to North Korea be referred to the International court of Justice, the Ministry of Foreign Affairs replies as follows:
It is such problems of legal nature as the Takeshima question or the so-called "Rhee Line " question that should be referred to the International Court of Justice for judicial settlement in case their solution through diplomatic negotiations turns out to be difficult, and if the proposal of the Government of the Republic of Korea be as such the Japanese Government will welcome it.
The repatriation of Koreans to North Korea, however, is the returning home of individuals concerned by their free choice, and therefore, it is a humanitarian problem based on fundamental human rights which no Government could possibly inflinge upon or restrict. The Japanese Government has consistently made it clear, both before the reopening of the Fourth Japan -Korea Overall Talks and throughout these talks, that the Japanese Government will carry out its already established policy, dealing with this problem solely in accordance with the free will of individuals. The facts that the International Committee of the Red Cross, recognized internationally as the supreme authority on humanitarian questions, has approved this basic position of the Japanese Government, that the repatriation works are actually being carried out under the supervision and with the assistance of this international institution and that many countries of the world are supporting the above-mentioned policy of the Japanese Government, prove amply and objectively that this problem is of purely humanitarian nature and that such basic position of the Japanese Government and its policy pertaining to the disposition of this problem are just and proper.
In view of the above, the Japanese Government considers that this problem should not be and need not be referred to the International Court of Justice.
