Subject Implementation of the terms agreed on at the conclusion of Korea-Japan Preliminary Talks. In order to Interpret and implement the terms agreed on in the documents signed on December 31, "1957", it is considered necessary for the two Governments to set up urgently a working committee for preparation of overall talks. The establishment of the above committee is necessary particularly for successful implementation of the following points:
1. According to the Memorandum of Understanding and Joint Communique, our Government "will accept the deportation of Korea illegal entrants". Attention is invited to the point that the scope of such Korean illegal entrant is not to be confined to those who are being detained at the Japanese camps, but include all those who proceeded to Japan without valid passport after the end of World War II. Japan may argue that she will be free in deciding who should be deported. But our fear is that Japan may try to protect in her territory Korean illegal entrants of certain category.
2. According to Annexed Understanding, necessity for the help for the livlihood of the release Koreans will be taken into consideration. We will watch with deep concern what action will be taken by the Japanese Government in this regard.
3. By Oral Statement, Japan will turn over to Korea those Korean art object now in possession of which the immediate transfer is possible. Therefore, Japan is obligated to present without delay the lists of the above art objects which will be satisfactory to us.
4. Unless we are assured by Japan that the above three terms will be faithfully observed, we on our part must hesitate to do what we should do according to the agreed terms.
5. In according with the signed terms we will repatriate those fishermen who have served out their sentences and are being detained at the aliens detention camp as of December 31, 1957. Please keep in mind that we did not promise to refrain from detaining Japanese fishermen other than those detained as of December 31, 1957.
Under these circumstances, you are instructed as follows:
A. Propose without delay to set up a working committee for preparation of overall talks. If it is agreed to set up such committee, our representatives will be headed by Minister Yiu.
B. The whole problems concerning interpretation or implementation of the signed documents should be discussed and settled at this committee. The Mission should decline to discuss anything with the Japanese side on this matter before setting up the committee.
C. The Japanese side proposes to dispatch its vessels to Korea to take over the fishermen, please reply to the Japanese that those fishermen will be transported by Korean vessels, and not by Japanese vessels.
D. If the Japanese side starts to release in Japan Korean detainees, dispatch some members of the Mission to the Japanese camps and report on the detailed situation there.
E. Send as soon as possible the list of Korean ilegal entrants who are being detained at the Detention Camps and those illegal entrants who are not in such camps, and those Korean residents who have been residing in Japan since prior to the end of world war two & are being detained at the ▣▣ Detention Camps, to be releaced pursuart to the terms agreed on.
