In view of the special background of migration to and residence in Japan of the nationals of the Republic of Korea who have been residing in Japan since the date of the termination of hostilities of the Pacific War and since prior thereto (hereinafter referred to as Korean residents in Japan ), and of the fact that the great majority of them, having little property or being unemployed, are under destitute condition; and
in recognition of the necessity of taking special measures to enable as many Korean residents in Japan as possible to repatriate to the Republic of Korea within a short period of time,
the Government of the Republic of Korea and the Government of Japan agreed in principle as follows:
1. For the Korean residents in Japan who will repatriate to the Republic of Korea,
a. the Government of Japan shall
i) pay certain amount of compensation, for those who will repatriate to the Republic of Korea within a certain period of time, to be used for their repatriation to and resettlement in the Republic of Korea ;
ii) provide necessary facilities and conveniences for their repatriation;
iii) allow the repatriates to take away all of their property and to remit the total amount of their fund in accordance with the arrangements to be made by the Governments of the Republic of Korea and Japan.
b. the Government of the Republic of Korea shall
i) accept the repatriation of Korean residents in Japan regardless of their political activities during their stay in Japan ;
ii) take necessary steps tor the assistance in their settlement in the Republic of Korea.
2. For the Korean residents in Japan who choose to reside continuously in Japan, the Government of Japan shall accord them, as long as they wish to remain in Japan, national treatment except in regard to the franchise and the right to become government officials.
