Verbal Note
The Foreign Officehas the honour to inform the Embassy of the Republic of Koreawith reference to the latter's Verbal Note, dated February 17, 1960 with which the Foreign Officewas asked about an information in connection with the agreement of the settlement about the liabilities of the Federal Republic of Germanytowards the United States of Americanfrom the delivery of surplus goods to Germanyon February 27, 1953, the following:
1.) It is not correct that the Federal Governmenthad paid to the Government of the United Statesonly an amount in the value of 37,5% of the sum indebted to the United Statesfor surplus goods delivered to Germany.
2.) The Federal Governmentcame merely to the following agreement with the Government of the United Statesfor carrying out the agreement between the Federal Republic of Germanyand the United States of Americaabout the regulation of the liabilities of the Federal Republic of Germanytowards the United States of Americafrom the delivery of surplus goods to Germanyof February 27, 1953 :
a) To the implementation of Article IV of the agreement:
An exchange of letters between the representative of the United States of America in the Three Powers Committeefor Germandebts at the LondonDebt Discussions and the Head of the German Delegation for Foreign Debts at these discussions of February 27,1953.
Subject of this letter are the "speeded up DM-payments" to be made on call by the Federal Governmenton its debt according to article I of the agreementof February 27, 1953 and the settling of these with this debt.
b) To the implementation of Article I and VIIof the Agreement :
Two governmental agreements effected between the former Charge d'Affaires a.i. of the Federal Republic of Germanyin Washingtonand the Department of Stateof May 17 until August 17, 1954 and March 11 until April 14. Subject of these agreements are the recourse claims of the Federal Republictowards the United States, which may arise from that, that Third parties may successfully demand compensation claims from the withdrawal of certain surplus goods, sold to them, through the United States, towards the Federal Republic of Germanyor the authorities acting for them; and the satisfaction of these recourse claims by reduction of the debt of the Federal Republicaccording to Article I of the Agreementof February 27, 1953.
3.) The Federal Republicuntil now fulfilled her obligations arising from the agreement quoted under 2.) to full extent and will do this also in future.
4.) The development of the German-American governmental discussions, leading to the conclusion of the Agreement of May 17 until August 17, 1954 and March 11 until 14th of April 1955, results from these agreements.
The Foreign Officeavails also of this opportunity to renew to the Korean Embassythe assurances of its highest consideration.
