AGREED MINUTES

December, 1959

With regard to the repatriation and the treatment of the Koreans who have been residing in Japan since prior to the termination of hostilities of the Pacific War (hereinafter to be referred to as Korean residents in Japan ), the Delegates of the Governments of Japan and of the Republic of Korea, taking into consideration the special position of Korean residents in Japan, reached agreement in principle, at the meeting on December, 1959 of THE COMMITTEE ON Legal Status of Korean Residents in Japan at the 4th Japan-Korea Overall Talks, as follows:
1. The Government of Japan will:
(a) provide necessary facilities in Japan for the collective repatriation of the Korean residents in Japan to the Republic of Korea during a period to be specified; and
(b) respect the property rights of the Korean residents in Japan who will repatriate to the Republic of Korea and allow them to take home all their property in principle. However, the method, timing and so forth will be decided through consultation between the two Governments.
2. The Government of the Republic of Korea will:
(a) accept the repatriation of Korean residents in Japan regardless of their political affiliations during their stay in Japan ; and
(b) take necessary steps for their resettlement in the Republic of Korea.
3. The Government of Japan will recognize for the Korean residents in Japan while remaining therein the rights they enjoy, excepting the franchise and the eligibility for public offices.
On the basis of the above principles and of other understandings, the Governments of Japan and of the Republic of Korea will conclude as soon as possible an agreement or agreements in concrete form concerning the matters mentioned above and other problems related thereto.
