NOTE VERBALE
The Korean Mission in Japan presents its compliments to the Japanese Ministry of Foreign Affairs and, has the honor to refer to its Note Verbale of February 13, 1959, in which the former set forth its position on the attempt of the Government of Japan to "repatriate" en masse Korean residents in Japan to the northern part of the Republic of Korea which is under unlawful occupation of the Communist puppet regime.
In the Note Verbale under reference, the Korean Mission made it clear in unmistakable terms to the Ministry that the Government of the Republic of Korea is strongly opposed to the plan of the Government of Japan to "repatriate" on masse Korean residents in Japan despite its efforts for justification by every possible pretensions, that the Japanese "repatriation" plan, which is virtually a deportation scheme, is nothing but a political plot originally initiated by the north Korean puppet regime with malicious intent to wreck the Republic of Korea-Japan relations, that Korean residents in Japan had deliberately been bribed and deluded with honey-coated promises, that, in view of the peculiar background of the migration into Japan of most of the Korean residents in Japan, it would be most inhumane to drive them out of Japan without any due compensation for their sufferings for many years, and that the Government of the Republic of Korea, as the only lawful Government in Korea, has the due right and responsibility to protect its own residents in Japan.
To the regret of the Government of the Republic of Korea, however, the Government of Japan did not take a slightest heed of the above representation of the Korean Mission to hastily go ahead with its scheme for deporting Korean residents in Japan to the northern part of the Republic of Korea now under illegal occupation of the Communist puppet regime.
Since Japanese Foreign Minister Aiichiro Fujiyama said in his letter of March 4, 1959 to Foreign Minister of the Republic of Korea Chung Whan Cho that "the Japanese Government is prepared further to talk over the matter with the Korean Government...," the Government of the Republic of Korea has repeatedly requested the Government of Japan to reconsider its stand, reminding the latter of serious consequences that might ensue if the Government of Japan should dare to implement the contemplated deportation scheme.
Notwithstanding the sincere efforts on the part of the Government of the Republic of Korea to settle the problem of Korean residents in Japan in most amicable manner, the Japan Red Cross was entrusted by the Government of Japan to undertake negotiations with the so-called Red Cross Society of the northern Korean puppet regime and, reached the so-called Agreement on August 13, 1959 on the "repatriation" to the northern part of Korea of Korean residents in Japan. In spite of its pretension that it has nothing to do with the works undertaken by the Japan Red Cross, it is a well-known fact that the Government of Japan, out of its own budget, actually subsidised, in Japanese currency, the amount equivalent to approximately US $460,000 for the works of the Japan Red Cross in connection with the "repatriation" of Korean residents in Japan. It is particularly noted that the so-called agreement as mentioned above, referring to the matters relating to the property rights of "repatriating" Koreans, stipulated that "repatriating" Koreans "may take with them up to Yen 45,000 in Japanese currency ...." It goes without saying that these terms of promise cannot be implemented without prior understanding and positive cooperation by the Government of Japan, which, from the outset, made a decision on and played a vital role in the above-mentioned deportation scheme.
However, it was in the spirit of eliminating causes for mounting tensions between the Republic of Korea and Japan and, thereby, maintaining the peace and security in the Far East that, at the initiative of the Government of the Republic of Korea, the Korea-Japan talks, which could not but be suspended by the reason for which the Government of Japan was solely responsible, were resumed. At the meeting thus reconvened on and after August 12, 1959, it was agreed between the delegations of the Republic of Korea and Japan that the problems of Korean residents in Japan were to be discussed with priority over other issues because they were the main causes for deteriorating relations between the two countries. Throughout the period of discussions held since then, formally and informally, the Government of the Republic of Korea has negotiated with the Government of Japan in the expectation that the latter would now sincerely reconsider its reckless attempt to drive to the Communist slavery free people for whose present predicament the Government of Japan is wholly responsible, reminding emphatically on numerous occasions that the problem of Korean residents in Japan could be and should be settled only through the talks with the Government of the Republic of Korea strictly in accordance with the terms of the Agreed Minutes, of December 31, 1957.
It leaves no doubt that the recent actions and inactions on the part of the Government of Japan are an open violation of the Agreed Minutes under reference, in which Ambassador Yu Taik Kim, then-Chief of the Korean Mission in Japan and Foreign Minister of Japan Aiichiro Fujiyama, respectively, on behalf of their Governments, formally agreed, on December 31, 1957, on agenda items to be taken up for settlement at the Fourth Korea-Japan Talks presently under way. The Ministry is reminded that these agenda items included:
Status and treatment of Korean Residents :
a. Status and treatment of Korean Residents : b. Property right acquired Korean residents : c. Property to be taken by repatriating Koreans.
As a result of a faithful interpretation of the aforementioned parts of the Agreed Minutes, the Government of the Republic of Korea cannot but be at a loss how to understand the attitude of the Government of Japan, which is unilaterally and arbitrarily pushing its way through to carry out its political aim to deport as many Korean residents as possible now residing in Japan.
Furthermore, it might as well be remembered that, when the two Delegations to the Korea-Japan talks issued a joint press release regarding the way of settlement of the problem of the Korean residents on August 26, 1959, the Japanese side agreed to confirm that there are three items in dealing with the problem of the Korean residents in Japan : namely, (A) those Koreans who wish to remain in Japan, (B) those Koreans who wish to repatriate to the Republic of Korea, and (C) those Koreans who would neither wish to remain in Japan nor wish to repatriate to the Republic of Korea, if any. It is the view of the Government of the Republic of Korea that the confirmation of the three items for discussion as referred to in the said joint press release is nothing but a logical consequence of interpretation and application of Article 3 of the Agreed Minutes of December 31, 1957. Since the day of this confirmation by mutual agreement of the three items of the issue placed at the diplomatic talks, the Government of the Republic of Korea has exerted efforts to settle in succession these three items of the problem in the high expectation that the whole problem of the Korean residents in Japan would be settled eventually and finally, only to be met with the insincerity and delaying tactics on the part of the Government of Japan.※The wording of this sentence would be modified or deleted as a whole in the light of the situation actually prevailing at the time presenting this Note.
Contrary to the expectation of the Republic of Korea and to its great disappointment, the latest development indicates that, far from discarding its attempt, the Government of Japan is likely to be on the threshold of going through the stage of real implementation of its deportation scheme. The Government of the Republic of Korea wishes to know whether the Government of Japan is really intending to carry out its unilateral deportation of Korean residents in Japan. In this connection, the Government of the Republic of Korea is obliged to request the Government of Japan for an adequate explanation as to how the Government of Japan is competent to dispose unilaterally of the agenda items which the two parties mutually agreed to place at the diplomatic talks at the very juncture when such diplomatic talks are under way. Therefore if the Government of Japan really intends to take an unilateral action in this regard the Government of the Republic of Korea cannot but believe that such action has been motivated by its intention to wreck the diplomatic talks presently under way in precognition of the relations between the Republic of Korea and Japan which might be gravely deteriorated.
Such being the circumstances, the Korean Mission hereby lodges a most energetic protest with the Government of Japan against its continued efforts to deport unilaterally Korean residents in Japan, requesting the latter to prevent urgently the present ominous situation from being developed in the direction of undermining to the ground the relations between the two nations. The Korean Mission further wishes to state that the Government of Japan would be solely responsible for any serious consequences that might arise should it carry out its unilateral measure for mass deportation of Korean residents in Japan to the Communist-held northern part of Korea.
