Tentative Policy concerning the Current Korea -Japan Overall Talks
I. Problem on Legal Status and Treatment of Korean Residents in Japan :
("Korean residents in Japan " shall mean those Koreans who have been continuously residing in Japan since prior to August 15, 1945 and their lineal descendants residing in Japan )
It is the basic policy of our delegation is the negotiation with the Japanese side on the subject matter that, in view of the background of these Korean residents in Japan, a special legal status for them should be established and, at the same time, that Korean residents should be discouraged to the maximum degree from intending to leave Japan for the northern part of Korea by ensuring their rights and interests in Japan to the maximum extent.
1) Treatment of those Koreans who will reside in Japan permanently.
a) Our side will request that a permanent residence status be accorded to the Koreans falling under this category without any conditions in this regard.
b) It is aimed that the Korean residents should be made free from the fear of deportation by securing the stabilised status of permanent residence, and at the same time, that a stabilised living shall be ensured through the guarantee of property rights and occupational rights.
2) Treatment of those Koreans who will be desirous of repatriating to the Republic of Korea.
a) For those Koreans who will be desirous of repatriating to the Republic of Korea within a certain period, our sids will ensure the freedom of their repatriation by having the Japanese pay due compensation and by having the restrictions relaxed to the maxims extent regarding the funds and properties to be taken away by the repatriates.
b) Our Goverment will also take proper measures to help the repatriation and the settlement of the repatriates.
3) Measures on those Koreans who neither wish to reside in Japan nor wish to go to the Republic of Korea.
In case any Korean resident wishes to leave Japan and proceed to any country or area other than the Republic of Korea (Southern part of Korea ) for resettlement even after the decent status for the Korean residents to reside in Japan permanently was firmly established legally and economically, necessary measures should be taken to ensure the freedom of the individual concerned on the condition that the choice is made on his own genuine free will and that the continuous freedom of residence, movement and migration is ensured in such country or area.
II. Problem on Korean Art Objects:
We will demand that Japan return to us firstly those Korean art objects which are in possession of the Government, its agencies and public institutions of Japan.
III. Problem on Mutual Repatriation of Detainees:
It is a position of the Japanese Government that they will not agree to enter into substantial discussions of the Overall Talks including that of the deportation issue unless or until the timing is made known for the actual carrying out of the mutual repatriation of Korean and Japanese detainees.
As it is our side that originally proposed for the implementation of the mutual repatriation on the occasion of the reopening of the Overall Talks, it is believed that, if we would delay the actual repatriation in this regard beyond a reasonable limit of time, we would be confronted with difficulties in our international stand particularly on the occasion of the so-called ICRC mission being present in Japan.
IV. Problem on Lifting of Temporary Suspension of Trade:
The Government will consider the resumption of trade with Japan as soon as possible at an appropriate opportunity in consideration of the facts that the Japanese side wishes for an early resumption, of the trade relations in terms for creating favorable atmosphere for the smooth proceeding of talks and that the trade suspension is causing an elevation of market prices, not to speak of the seriousness in its effects on Korean residents' commercial activities.
