RECORD OF PROCEEDINGS OF THE "COMMITTEE ON VESSELS"
The 5th meeting of the "Committee on Vessels" was held on Nov. 9, 1951 at the Ministry of Transpotation office.
Discussion of the subject following the Agenda started from that day. In discussing agenda (a), the Korean Committee Member requested the Japanese side to submit the following data:-
(1) List of vessels, registered in Korea as of Aug. 9, 1945 including an inventory of their ship's stores and other equipment;
(2) Explanation on their status quo as of Sept. 11, 1951;
(3) Steps taken by the Japanese Government for maintaining their status quo as of Sept. 11, 1951;
(4) Date and method of their delivery;
(5) Opinion of the Japanese side concerning disposition of the fruits yielded from the Japanese use of the vessels during the period from Sept. 11, 1951 to their delivery.
In regard to the 5th item of the Korean request, the Japanese member asked the Korean side how they consider of the fruits yielded before Sept. 11, 1951. The latter replied that the title of vessels was vested to the United States Military Government in Korea since Sept. 25, 1945, and transfered to the Republic of Korea since Sept. 11, 1948, but they do not refer for the time being to the fruits yielded during the period from Sept. 25, 1945 to Sept. 11, 1951.
The Japanese Committee member asked the Korean side a question about the legal foundation of the demand for the return in Agenda (a), in reply to which the latter said that the demand has been based on SCAPIN 2168 dated September 11, 1951 and DS Note to the Korean Mission dated September 10, 1951,
The Japanese representative asked the Korean side a further question about the legal foundation under which the demand was made prior to the issuance of the above SCAPIN and Note, and the latter replied that it had been based on with the Korean Vesting Decree and the Initial Financial and Property Agreement between the United States of America and the Republic of Korea.
With regard to the 5 data requested by the Korean side, the Japanese
Committee member answered that he would make the reply after reviewing them.
