My dear General MacAthur:
The vesting decree promulgated by the American Millitary Government in Korea as Odinance No.33 pursuant to authority deligated by you, gave to Korea title to all property belonging to the Japanese Government and Japanese nationals which was located in Korea on or after August 9, 1945. This transfer of title was part of the consideration involved in our signing the quit-claim represented by the Initial Financial and Property Settlement Agreement between the United States and the Republic of Korea. It was reaffirmed with respect to fishing and other vessels in the negotiations concluded October 18, 1949, between Mr. KIM Yong Joo, representing Korea, and Mr. Jane, attorney for the Civilian Property Custody Section of SCAP. Thereupon a list of the vessels involved, which are now in Japanese waters, was submitted to Mr. Jane with a request that they be returned to Korea. No action was forthcoming. Hence the Korean Diplomatic Mission in Japan submitted a formal request for the return of these Korean vessels to the Diplomatic Section of General Headquarters, SCAP, under date of November 12, 1949. This request has been informally refused by your subordinates.
Prior to liberation of Korea its marine transportation system was comprised of approximately 600,000 tons of ships. Virtually all of these were taken to Japan by fleeling Japanese by the time the American Army Forces arrived in Korea September 18,1945, and have since remainded there. Ordinance No.33 provideds for restoration of only a fraction of the ships to which Korea is moral title. However, if Odinance No.33 is made effective Korea is willing at this late date to forego its claim to ships not in its harbors on or after August 9,1945, without SCAP permission and to return any Japanese ships loaned by SCAP to assist Korean economy.
I shall be deeply grateful if you will give this matter your personal attention and order the return to Korea of its ships wrongfully held by Japanese citizens.
