Enumerated below, with our future instructions, are the items which are to be considered and agreed upon as a whole before the formal conference is resumed. No item is to be considered as a separate item which can be settled independently of any of the other items.
1. Detainee Issue.
The wording of the memorandum on this issue, "THOSE JAPANESE FISHERMEN WHO HAVE SERVED THEIR SENTENCES are to be released and repatriated to Japan", should not be deleted from the memorandum under any circumstances. Further, there should be tagged to this memorandum no conditions such as "this clause should not be interpreted as signifying Japan's recognition of the Peace Line, etc." (Draft Memorandum is attached)
2. Property and Claims Issue.
We may accept the U.S. Memorandum pertaining to the subject issue, provided that the Japanese Government give us assurance that they will not propose reciprocal renunciations of the property claims and are ready to discuss and settle with sincerity Korea's claims against Japan. (Agenda items are attched)
3. Withdrawal of the Kubota Statement.
The Japanese Government, in its retraction of the Kubota statement, should not attach any explanatory warding. such as "personal opinion, etc." (Draft Note Verbale is attached)
4. Peace Line
The preliminary negotiations are left to you. However, in case it becomes impossible for you to achieve any concrete results concerning the Peace Line in the preliminary negotiations, you should see to it that an item entitled "Peace Line" shall be included in the formal conference agenda.
5. Nullification of the Annexation Treaty and Agreement.
The following item shall be included in the formal conference agenda as agreed,: Matters concerning the confirmation of the fact that the treaties and agreements concluded between Korea and Japan in or before 1910 are null and void.
6. Art Objects.
Japan's proposal to turn over out art objects aside from the conference agenda is acceptable under the proposed wording of a notification. (Draft Notification is attached)
7. Agenda of the Formal Conference.
Both sides will agree to discuss and settle all outstanding questions in accordance with agenda items listed in the agreed minutes. (Draft Agreed Minutes are attached)
8. Date for the Resumption of the Formal Conference.
Both sides shall agree to exchange a memorandum setting the date the formal conference is to be resound. The date shall be within a month at latest after all the pre-requisites herein mentioned are met by Japan. (Draft Memorandum is attached)
