재일한인 법적지위에 관한 훈령의 건

상기 대호 전문으로 청훈하신 건에 관하여서는 MT-0296호로 이미 지시한 바 있아오니 이 문제에 대하여 다음과 같은 자료를 송부하오니 참고하시기 바랍니다.
추기 : 별첨(1)은 퇴거강제에 관한 각국의 법령이며 별첨(2)는 퇴거강제자의 퇴거지에 관한 각국의 법령인바, 더욱 상세한 자료는 수집하는 대로 송부하겠아오니 여사 양지하여 주시기 바랍니다.
별첨 1
(1) Immigration laws and regulations, Brazil Previsions concerning non-admission and deportation "An alien who commits an offence against the State, the social or political order, public peace and morality or the national economy may be expelled from the country. The penalty of expulsion likewise applies to an alien who: Aliens who have lived legally for more than 25 years in the country or who have living illegitimate children of Brazilian nationality, may not however be expelled."
(2) Immigration laws and regulations, Peru Previsions concerning non-admission and deportation "Subject to certain conditions, aliens domiciled in the country are not liable to be expelled, nor are the widowers of Peruvian or persons married to Peruvian woman and living with them normally."
(3) British Imperial law of July 27, 1871, regulating expulsion by the police, as given in For. Rel. 1892, 13, reads:
II. The expulsion of a person from a community where his home and domicile is objectionable. When the right to domicile has been acquired in a certain place, expulsion from it cannot take place.
별첨 2
(1) Immigration laws and regulations, U.S.A. Country to which alien will be deported "The deportation of an alien who is being deported under Sections 236 and 237 of the Immigration and Nationality Act(Immediate deportation of aliens excluded from admission or entering in violation of law) shall be to the country whence the alien came, in accommodation of the same class in which he arrived, unless the Attorney General decides that immediate deportation is not practicable or proper."
(2) Immigration and alien registration laws, the Philippines (section 38) "An alien ordered deported shall, at the option of the Commissioner of Immigration, be removed to the country whence he came or to the foreign port at which he embanked for the Philippines, or to the country of his nativity or of which he is a citizen or subject, or to the country in which he resided prior to coming to the Philippines."
(3) Japanese Immigration Control Order (article 53)
1) Any person subject to deportation shall be deported to the country of which he is a national or citizen.
