3. Proceedings:
(1) Questionings and answerings.
a. Mr. OHNO mentioned that the 1st paragraph of the Preamble should be deleted in the Draft Treaty of Amity proposed by the Japanese Government.
b. With regard to the name of the Draft Treaty of Amity proposed by the Japanese Government, Mr. YU said that, considering that the treaty aims to solve various unpleasant pending problems between the two countries, it might be desirable to indicate a treaty concerning peace, and asked Mr. OHNO whether the Japanese side has any idea to use any other term involving some other sense than “Treaty of Amity”. Mr. OHNO answered that the “Amity” is just enough, for this conference is going to solve all pending problems between Korea and Japan on a friendly and amicable basis.
c. With regard to “the prompt solution of the various problems between them arising from their new relationship”, second paragraph, Preamble of the Japanese Draft, Mr. YU said the Korean side understood that the main purposes of this Conference were to solve all the pending problems including those which existed in the past as well as those arising from new relationship, and asked the Japanese side of the meaning of the use of term “new relationship”. Mr. OHNO said, in response to Mr. YU’s question, that the problems arising from the new relationship are the various problems arising at a certain period of time before and after conclusion of this Treaty.
d. With regard to Article 3 of the Japanese Draft, Mr. YU asked Mr. OHNO about the reasons why the Japanese side brought some new principles into the said Article of the Draft Treaty different from the provision of Article 12 of the Peace Treaty and also asked him about deleting Article 3 of the Draft Treaty or providing just as it was provided in Article 12 of the Peace Treaty. Mr. OHNO answered that according to the San Francisco Peace Treaty, Japan had only to accord to Korea most-favored-nation treatment or national treatment to the extent that Korea did, but in the light of the spirit of concluding a historical Korea-Japan treaty of amity restrictive application of most-favored-nation treatment or national treatment is undesirable in the friendly relationship between Korea and Japan, and further pointed out that from now on intercourses between the two nations would be very frequent and the clauses on freedom of Entry and Exit had better be established and provided.
e. Mr. OHNO asked Mr. YU whether the Korean Government had any adequate measure as to the termination of the Trade, Financial and Shipping Agreements between the Republic of Korea and Occupied Japan. Mr. YU answered that these problems would be settled in future between appropriate government officials other than at this Conference table.

It was agreed that the next (third) session would be held on February 29(Friday) at ten o’clock in the Conference Room of the Japanese Ministry of Foreign Affairs.
