Regulation for trade between China & Corea
These Regulation are in fact a treaty between China & Corea, in which China achieves the position of suzerain & the right of making special & exclusive arrangements with her dependency.
Li-hung-chang having first suggested a draft Treaty which has been signed by the United States, England & Germany, in which we have treated with the Sovereign of Corea on equal terms, now concluded a treaty in which the King of Corea appears merely as a vassal of China—as Sir H Parkes points out, the position is one which we cannot accept.
Either the king of Corea is an independent Sovereign with whom other sovereigns can make treaties, in which case the M.F.N. clause of our treaty gives us an equality with China:
Or, he is a vassal of China, in which case we may maintain that our treaty with China applies to this dominion.
A Mem is annexed which has been prepared in the China Dept, confirming the ‘Regulations’ with our treaty.
It will be seen that in expand to jurisdiction and customs Duties the Chinese have obtained much more favorable terms than we have.
I would suggest that we should in the first place communicate with the German Gov. & prepare to act together in the matter; and that the course we should then take, either jointly with them or alone, should be to instruct Sir H Parkes, (if he thinks it can be done without danger), to send Mr. Aston at once to Corea to inform the Corean Gov. that we claim the same treatment as China under the M.F.N. clause of our treaty, but that we should be prepared to negotiate a new Treaty in place of the unsatisfactory are concluded by Admiral Willes in which we should not insist on these clauses of the China Regulations which may not be suitable for the relations between England and Corea:
And that his Governor should be instructed to inform the Chinese Gov. that we claim the application of the M.F.N. clause in our treaty to their regulations.
