Your Excellency :
I beg to acknowledge receipt of Your Excellency's letter numbered 34 with appreciation.
Today, I called on the ICRC and had a talk with Mr. Gallopin for an hour. The gist of my talk with him is as follows:
Firstly, I told him that we proposed last week to the Japanese Government to agree to the judicial settlement of the issue at the International Court of Justice However, the Japanese official replied in their note verbal that since the ICRC has approved their plan of 'repatriation', the Japanese Government felt it unnecessary to bring the "humanitarian issue which was approved by the ICRC " to the Court. But, in any understanding, the ICRC 's participation in the Japanese scheme does not mean any approval of the plan. As 1 studied the statement issued by the Committee on August 11th, 1959, the ICRC repeatedly stated that the whole plan was to be carried out under the Japanese responsibility and the ICRC 's participation was only to "assist" the Japanese Red Cross plan. But now, the Japanese side says that the Committee has approved it. I wanted to have a clarification of the Committee on this Japanese claim.
Mr. Gallopin said that, "Mr. Minister, your understanding is entirely correct and exact and the ICRC has not approved the Japanese plan". Further, he said that the ICRC has not even a slight intension to prejudice any effort to seek the judicial settlement of the matter at the Hague Court. And the plan is carried out by the Japanese under their responsibility. It is surprising that the Japanese Government uses the ICRC 's name in their diplomatic note. Then, he added that he would instruct his representatives in Tokyo to find out the matter.
In this connection, it would be very helpful for us to give him a copy of the Japanese note mentioning about the ICRC. I have just sent a cable to the Government in this regard.
Then, I said to the Director-General of the ICRC that in my understanding, the Japanese side sent our people numbering 975 to the communist regime on 14th of December by a Soviet vessel and none of them who appeared at the embarkation port have changed their minds despite of your "confirmation of will" and that, as I said before, the ICRC 's so-called confirmation of will would be very difficult under the circumstances. Now time is opportune for the ICRC to reconsider whole situation and withdraw from Japan.
Mr. Gallopin said that he received a cablegram, from his representatives in Japan saying that three (3) persons have changed their minds on 18th of December in the presence of the ICRC people.
I said that these 2 or 3 are very small number and, on the other hand, these two cases show that the so-called registration was conducted under pressure. Furthermore, it became evident that the ICRC 's presence at Nigata port merely served to comfort the Japanese side and, so far as the actual confirmation of will is concerned, it was unable to conduct.
Mr. Gallopin said that because of the ICRC 's presence, he believe, possible physical pressure from the communist side was prevented.
I again said that the whole facts which I got show that the registration was phony one. I asked the ICRC whether they have supervised whole Japanese scheme.
They replied that they have visited registration offices.
I asked again whether they have visited all of the nearly 400 registration offices.
They admitted that they were not able to visit all of them, but, through the JRC, they had conducted a sort of indirect supervision.
However, the ICRC doesn't wish their work in Japan to he defined as supervision - their work in Japan is to simply 'assist' the JRC, according to their explanation.
Finally, Mr. Gallopin said that he wanted to make it clear that the ICRC has not approved in any way the Japanese plan.
