Excellency,
As I reported briefly to the Government by my cable dated July 24, I met American Minister here in Geneve at 3:00 p.m. on July 23 to sound out what he has in his mind recently regarding the deprtation issue.
With regard to the prospect of when the ICRC will make the so-called decision on the Japanese request, he said that he did not know it because stories are different from person to person whenever he talked with various officials of the ICRC. He added, however, that it was certain that ICRC officials were "carefully" studying the so-called agreement.
I told him that the Japanese were now desperately applying pressure on the ICRC to give the so-called decision to their request "at the earliest possible date". I told him the story that Jap Foreign Minister recently sent a cable the ICRC, urging that the ICRC should give approval to the Japanese request "at the earliest possible date", and that puppets were pressing the Japanese for signing the so-called agreement by setting August 5 as a sort of deadline.
He said that he had told the ICRC "recently" that "if the ICRC should intervene in the issue, a strict screening should be conducted under the ICRC 's responsibility". (He implied that the above was his Government's position in regard to the problem at issue.) He continued that toward the above representation, ICRC officials only mentioned that they were giving a "careful study" to the so-called agreement. He added that the ICRC observes "strict neutrality" in the military, political, religious and philosophical spheres.
I could not but believe that the US position was not necessarily opposing the ICRC 's intervention in the deportation issue, if certain conditions were to be met ---- a strict screening under the ICRC 's a responsibility Hypothetically, I asked him what kind of free choices, for example, could be accorded to the Korean residents in Japan. He said that , for example, they are free to reside in Japan continously if they so desire, they can free to return to the republic of Korea and that he thought that there should be certain number of real Communists in the Korean community in Japan, implying that such Communists might be allowed to go to the north if they so desire.
I told him that real Communists, if any, would not express " their will" to go to the north, because they have their own political purposes in staying in Japan. The following are the gist of my counter-remarks:
1) The Japanese scheme is nothing but a most malicious political conspiracy devised in collusion with the Communists to deal in human beings in violation of basic human rights. The Japanese are anxious of getting rid of Koreans out of Japan, depriving them of every human right. (I explained to him once again about the reasons for opposing the deportation scheme. as enunciated by our Government. )
2) From the fundamental standpoint, the ROK position is based on the belief that it is a violation of every democratic principle, for which all free peoples stand, to send anyone to Communism. Further, as far as the Universal Declaration of Human Rights is concerned, it stipulates an absolute and continuing freedom of movement or choice of residence, while prohibiting enslavemest of human beings and application of pressure, discrimination, intimidation, duress, etc. It is a well-known fact that if Koreans in Japan, once handed over to the Communists, can never be allowed to get out of the Communist sphere however hard they may desire, thereby being completely deprived of their freedom of movement or choice of residence forever.
3) I also pointed out that the 600,000 Korean residents in Japan are not free to reside in Japan, as Minister Villard said. They are very human beings to whom every sort of pressure is constantly applied in breach of their basic human rights. In addition, the Japanese Government adamantly refused to legally guarantee their residence right in Japan, despite that they are entitled to such rights according to international law and practice and in view of the background under which they had been brought over to Japan. In spite of the fact that the SCAP also recognised such residence right of the Korean residents in Japan, the Japanese Government, with the signing of the Peace Treaty, began a concerted campaign to expel them out of Japan by detaining them for deportation in the so-called Detention Camps in Japan. We should not shut our eyes to all these situations where the Korean residents are presently placed when we discuss problems relative to the Korean residents in Japan.
4) I finally told him that our country could not cease its struggle against Communism even for a moment.
Minister Villard took note of the fact that the Japanese Government has refused to legally guarantee the residence right of the Korean residents in Japan and that they are of "special background" different from other aliens. Through my conversation with the Minister, I got the impression that the United States was mainly concerned about how to minimise the number of the so-called repatriates to northern Korea rather by the ICRC 's "strict screening"; which is apart from our stand. Both Minister Kim and myself are now strongly determined to fight our way to block the Japanese political plot. We are now doing our beat to prevent the ICRC from giving the so-called approval to the Japanese request.
