3. Gist of Talks:
Mr. Lee:
Shall we open today's session ? To briefly state the proceeding of this Subcommittee up to the last session, we started discussing substantial probelm under Agenda A after apending a considerable length of time in discussing the problem of the adoption of agenda items at this Subcommittee. And my delegation gave a full account to the Japanese side on the legal of Korean claims to the vessels of Korean registry. Thereafter, my side presented to your side the first list of 31 vessels which covers a part of those vessels which the Japanese side recognized at previous Conferences as the vessels of Korean registry located in Japan. However, the Japanese side has not given my delegation a clear answer thereto. So I would like to make a request to you again tor a reply to the list, today.
Mr. Asada:
As I told you at the previous session when I expressed few words of greeting, I have been studying on the problem of Agenda A since I tock the place of Mr. Awasawa. Such being the circumstances, I am not well acquainted with the problem in question, as yet. However, as far as my knowledge goes, though both sides exchanged views on the said problem, the conflicting views between us on the legal basis of Korean claims under reference have not been solved. Accordingly, it is difficult for the Japanese side to give you a definite answer to the problem of Agenda A at the present stage. Rather, I would like to remind you that it is incumbent upon us to settle all of the problems of vessels at this Subcommittee. Therefore, I think it will be a better way of proceeding our meetings if we proceed to Agenda B and, subsequently, to Agenda C and D as there still exists difference of opinions in connection with the legal basis of the Korean claims under Agenda A.
Mr. Lee:
As I have repeated I told the Japanese delegation, the Korean claims under Agenda A is based on SCAPIN 2168, and the SCAPIN itself have legal bearings on Ordinance No.33 of the Military Government of the United States in Korea and, further, on Article 4 (b) of San Francisco Peace Treaty. I believe the Japanese side well understand them. Nevertheless, your delegation has been developing a legal theory which cannot be understood with the sense of justice and equity. It is with regret that the Japanese delegation does not show any of constructive opinions for the settlement of this problem. Under the standing rules of proceeding a conference, I firmly state that we take up the problem of Agenda B onlyafter we settle the question of the veesele of Korean registry in Japan.
Mr. Asada:
My side is proposing the method of proceeding which I mentioned previously for the smooth operation of this Subcommittee.
Mr. Lee:
To enter into the discussions of Agenda B, leaving the problem of Korean registry vessels under Agenda A unsettled ls contrary, to the principle of the proceedings. Therefore, I would like to emphasize once more that we settle the issue of Agenda A prior to taking up the problem of next agenda item.
Mr. Asada:
The Japanese delegation received the first list in question just tor its reference because the difference of opinions between us was not ironed out. In consequence, I am not in a position to give a reply to the list whatsoever.
Mr. Lee:
I hope the Japanese side, seeing off the twisted Interpretation of the legal basis on the problem of Agenda A, show more sincerity and proceed the talks with constructive idea for the prompt settlement of this issue.
Mr. Asada:
The above Japanese method stems from the idea of proceeding our metings more effectively, because it would contribute greatly to the smooth proceeding of this Subcommittee if we take up the problems of Agenda B, C, and, D according to their orders and, at later stags, we renew discussions on the unsettled problems and settle them in a whols. Would you please reconsider the Japanese proposal ?
Mr. Lee:
I rather ask you to accept the principle of standing rules of proceeding of meetings. I think it would be of little use to continue our talks in this way, today. I want the Japanese side to reconsider the matter under discussions and to give an early reply to the Korean request.
When shall we meet next ?
Mr. Yoshikawa:
I heard that the Korean side proposed that we eater into receass from the 20th of December, at a meeting held between Dr. Sawada and Ambassador Limb, So, why don't we decide the date in accordance with the decision which might be made between them ?
Mr. Lee:
I don't have knowledge of it, and my delegation hasn't received instructions in this regard. So, we might as wall decide the date tentatively
Mr. Asada:
No objection.
Mr. Lee:
Any suggestion for press release ?
Mr. Asada:
Let us state in press that we continued substantial discussions and decide the date of next session tentatively.
Mr. Lee:
No objection.
