GIST OF TALKS SIXTH SESSION SUB-COMMITTEE ON VESSELS, COMMITTEE ON KOREAN CLAIMS

Minister Yiu:
If the Japanses side has come to any conclusion on the proposal I made at previous meeting, I would like to hear lt.
Mr. Awasawa:
The Japanese side has reached a conclusion after painful studies on the proposal from every possible angle that the same agenda items that were discussed at the previous Korea-Japan Conferences would be taken up as the agenda items of this Sub-committee, without attaching any word thereto.
Minister Yiu:
Please tall me If there was any particular reason with which the Japanese side would be difficult to accept my proposal regarding the proposed agenda Item (d).
Mr. Awasawa:
The Japanese side is of the view that, unless there exists a basic reason to change the said agenda items, it is quite natural to take up the same problem under the same agenda items that were discussed at the previous Conferences in conformity with the understanding reached on December 31 1957.
Minister Yiu:
As I would like to see to it that the proviso reading "as of November 6, 1951" be attached to the agenda "item (d)", I want to urge you once more to reconsider the proposal.
Mr. Awasawa:
Would you, please, tell me the definite wordings you like to attach to the end of the agenda "item (d)?"
Minister Yiu:
I proposed that the phrase, as of November 6, 1951, be added to the agenda "item (d)" to read: "... the fishing vessels detained in Korea as of November 6, 1951."
Mr. Awasawa:
Does the date "November 6, 1951" has any particular implication ?
Minister Yiu:
November 6, 1951 is the date when the agenda items of the Committee on Vessels, the First Korea-Japan Conferences, were adopted.
Mr. Awasawa:
As we have agreed upon reporting the problem of the "141 fishing vessels" to the high levels of the both sides for the decision on the measures on how to handle the problem, I do not see any necessity of adding the aforesiad proviso to the agenda "item (d)."
Minister Yiu:
My proposal does not cover any now matter. It is simply purported to clarify the fact as it is. Therefore, I can hardly understand why the Japanese side can not accept it.
Mr. Awasawa:
There are two facts we have to recognie. One is the fact originated from the problem of "141 fishing vessels," and othe other is the fact concerning the fishing vessels detained in Korea as of November 6, 1951. Suppose we attach the proviso, which you have proposed, to the agenda "item (d)", it will result in stipulating latter fact only, and, consequently, the former fact will automatically be erased out.
Minister Yiu:
I don't think that way. The problem of the so-called "141 fishing vessels" has nothing to do with the agenda item (d), as the matter was to be reported by the Japanese side to its high level for the decision by the high levels of the both sides regarding how to handle the problem.
Mr. Awasawa:
I am afraid that the proviso reading "as of November 6, 1951" may imply that the problem of "141 fishing vessels" will never be taken up at this Sub-committee forever.
Minister Yiu:
Your side stated that the problem of the so-called "141 fishing vessels" would be reported to your high level and, also, that the Sub-committee on Vessels would not take up the issue unless otherwise decided and instructed by the high levels of the both sides.
Mr. Awasawa:
It is hard for me to understand your intention of adding a new proviso to the agenda "item (d)" that had continuously been adopted, without any clange in its wordings, as one of the agenda items of the Committee on Vessels throughout the first, second, and third Korea-Japan Overall Talks.
Minister Yiu:
Since the discussions at the Overall Talks on vessels lasted without touching on substantial matters on vessels in question at the second and third Conferences, and, besides, as the Japanese side did not come out with such a problem as the so-called "141 fishing vessels," the Korean side just did not see any particular necessity of altering the wordings of the agenda "item (d)" at the second and third Korea-Japan confarences.
Mr. Awasawa:
As I have repeatedly told you, the Japanese side will report to its high level on the problem of "141 fishing vessels. Acoardingly, we need not to amend the agenda items any more.
Minister Yiu:
Now that the Japanese side finds it very difficult to consent to my proposal to add a proviso to the end of the agenda "item (d)," I will amend it. I introduce here an alternative that the phrase, as of November 6, 1951, be inserted within a bracket at the end of the agenda "item (d)," two read: "...the fishing vessels detained in Korea(as of November 6, 1951)."
Mr. Awasawa:
I am afraid that the Japanses side is unable to accept that either.
(silence)
Mr. Takano:
What do you specifically imply by wording, "as of ?"
Do you mean that the vessels which were not detained on the very day of November 6, 1951 shall be excluded from the discussions under agenda item (d)?
Minister Yiu:
The phrase, the fishing vessels detained in Korea as of November 6, 1951, does not mean to expand our discussions under the agenda item (d) to the vessels detained after the very date. As the wording, detained in Korea, speaks for itself, the phrase means that the vessels which had been under detention in Korea, and not by Korea, on or before November 6, 1951 will fall within the scope of the agenda item (d). However, if the Japanese side sees certain complicated apprehensions in regard to the phrase, as of November 6, 1951, I don't mind substituting a phrase, at the time of the first Korea-Japan Conference, for the phrase, as of November 6, 1951.
Mr. Choi :
Let me advise you to accept the proposal by Minister Yiu, taking into consideration the suggestion he made in connection with a proviso.
(Silence for approximately 10 minute. )
Mr. Awasawa:
I still find it difficult to accept the proposal due to delicate domestic situation, Besides, now that the Diet is in full session, and tries to find fault with the Administrative, I have to be all the more cautions in negotiating with you on the issues pending.
Minister Yiu:
Your remarks make me entertain an impression that the Diet does not want to see a satisfactory conclusion of the Korea-Japan Overall Talks.
Mr. Awasawa:
No, not at all. The Dist is anxious to see an earlier settlement of the pending issues between the two countries under a friendly atmosphere. However, it is, at the same time, very anxious to see that legitimate assertion on the part of the Japanese side are well filed,
Minister Yiu:
My proposal is aimed at endorsing the fact as it is. It by no means inflinges upon any "legitimate" interest of the Japanese side.
(Silence for nearly 10 minutest )
Mr. Awasawa:
As the discussions under the agenda item (d) at this Sub-committee would be limited to these vessels detained in Korea as of November 6, 1951 pending the decision by the high levels, I think it is not necessary to add a condition to agenda items adopted at the previous Conferences.
(Silence )
Minister Yiu:
Let us not spare our effort in reaching a conclusion regarding this matter at today's meeting.
Mr. Awasawa:
I have boned upon it from the every possible angle, but always come across the answer that the Japanese side can hardly accept the proviso, no matter whether it will be inserted in the bracket or not.
Minister Yiu:
I want to remind you that my suggestion with the proviso anclossd in the bracket was devised out after a long deliberation.
(Silence for approximately twenty minutes )
Minister Yiu:
It seems to me that we may not arrive at any conclusion on the matter at this Sub-committee today. Therefore, I hope you reconsider the matter later. And, I propose to put an end to our meeting of to-day. Concerning the data for next meeting, let us decide through phone.
Mr. Awasawa:
No objection.
Minister Yiu:
I suggest to state in press release that the both sides failed in reaching an agreement in respect of the problem of adopting agenda items.
Mr. Awasawa:
I think we had better state that the both sides exchanged views on the proceeding of the meetings of Sub-committee.
Minister Yiu:
No objection.
