The Ministry of Foreign Affairs presents its compliments to the Korean Mission in Japan and has the honor to notify the latter as follows:
The Government of Japan withdraws the remarks made by Mr. Kanichiro Kubota, Chief Japanese delegate, on October 15. 1953, against which the Korean Delegation protested.
Further, the Government of Japan hereby withdraws the claim to property in Korea made by the Japanese Delegation at the Korea-Japan Talks on March 6, 1952, on the basis of the "Statement of U.S. Position on Interpretation of Article 4 of the Japanese Peace Treaty with Respect to Korea-Japanese Claims Settlement" dated June, 1957.
This in no way relates to Korean Claims against Japan and Japanese nationals which are entirely separate matter.

MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE REPUBLIC OF KOREA AND THE GOVERNMENT OF JAPAN REGARDING MEASURES ON KOREANS DETAINED IN JAPAN AND JAPANESE FISHERMEN DETAINED IN KOREA.
 

The Government of the Republic of Korea and the Government of Japan have agreed to take the following measures:
The Government of Japan will release these Koreans who have been residing in Japan since prior to the end of World War II and who are being detained at the Aliens Detention Camps in Japan. (-----)
The Government of the Republic of Korea will repatriate to Japan the Japanese fishermen who have served out their sentences and are being detained at the Aliens Detention Camp in Korea; and will accept the deportation of Korean illegal entrants after the end of World War II.
The present memorandum of understanding shall come into force on the date of signature.
Done in duplicate at Tokyo, this day of June , 1957

ANNEXED UNDERSTANDING
 

In the expectation that the general talks between Japan and the Republic of Korea will be resumed from September 2, 1957, and that the problem of the treatment of Korean residents in Japan, including arrangements for the acceptance of deportees, will be discussed and settled without delay in those talks, the Government of Japan will, until satisfactory arrangements are made, refrain from detaining those Koreans who have been residing in Japan since prior to the end of World War II to keep them in the Aliens Detention Camps, In releasing the Korean residents detained at the Aliens Detention Camps, necessity for the help for their livelihood during the initial period after their release will also be taken into consideration.

AGREED MINUTES
 

1. Minister for Foreign Affairs of Japan:
With reference to the first paragraph of the Memorandum of Understanding regarding Measures on Japanese Fishermen Detained in Korea and on Korean Detainees the Government of Japan will complete the prescribed measures within one and a half months from the date of the coming into force of the Memorandum.
Chief of the Korean Mission in Japan:
With reference to the second paragraph of the said Memorandum, the Government of the Republic of Korea will complete the prescribed measures within one and a half months from the date of the coming into force of the Memorandum.
2. Chief of the Korean Mission in Japan:
I understand that when the problem of treatment of Korean residents in Japan is discussed at the overall talks to be resumed between the Republic of Korea and Japan, the problem of the deportation of illegal entrants will also be a subject of discussion.
Minister for Foreign Affairs of Japan:
So do I.
3. Chief of the Korean Mission in Japan:
I understand that the agenda of the overall talks to be resumed between the Republic of Korea and Japan will be the same five items that were discussed at the first, second and third Korea-Japan Conferences.
I further understand that the following problems are included in the said five major items to be discussed at the overall talks:
1) Basic relations:
a. Matters concerning the confirmation of the fact that the treaties and agreements concluded in and before 1910 are null and void.
b. Respect for and non-intervention in sovereign rights.
2) Status and Treatment of Korean Residents:
a. Status of Korean residents in Japan.
b. Property rights acquired by Korean residents.
c. Property to be taken by repatriating Koreans.
3) Fisheries and "Peace Line".
a. Matters concerning "Peace Line."
b. Matters concerning the conclusion of a fishery agreement to provide for measures to prevent fishing disputes and to conserve fishery resources.

4. Chief of the Korean Mission in Japan:
In connection with the Korean claims, the Korean side would like to submit for discussion and settlement at the overall talks to be resumed, the same proposal that it had submitted at the previous talks.
Minister for Foreign Affairs of Japan:
In such case, the Japanese side has no objection to discussing for settlement such Korean claims with sincerity.
Minister for Foreign Affairs of Japan:
I understand that with respect to the "Statement of the US Position on the Interpretation of Article 4 of the Japanese Peace Treaty with Respect to the Korean-Japanese Claims Settlement" dated June , 1957, the Government of the Republic of Korea is also of the same opinion with the said statement. I further understand that the said US Statement does not signify the reciprocal renunciation of the property claims, and does not affect Korean claims in any way.

JOINT COMMUNIQUE
 

At a meeting between Ambassador Yu Taik Kim, Chief of the Korean Mission in Japan, and Mr. Nobusuke Kishi, Minister for Foreign Affairs of Japan, on June , 1957, it has been agreed that the Government of Japan will release those Koreans who have been residing in Japan since prior to the end of World War II and who are being detained at the Aliens Detention Camps in Japan and that the Government of the Republic of Korea will repatriate Japanese fishermen detained at the Aliens Detention Camp in Korea and also will accept the deportation of Korean illegal entrants after the end of World War II.
At the same time, the Government of Japan has notified the Government of the Republic of Korea that it withdraws the remarks made by Mr. Kanichiro Kubota, Chief Japanese Delegate, an October 15, 1953, and that it also withdraws the claims to property in Korea made by the Japanese Delegation on March 6, 1952. (... )
As a result, it has been agreed that the overall talks between the Republic of Korea and Japan will be resumed in Tokyo on September 2, 1957.
