3. Questioning and answering
a. The session was commenced with an explanation by Mr. CHIBA of Japanese basic views, in answer to Mr. YIM’s question in the preceding session as to which of the two following principles is fundamental to Japan; principle of the assurance of freedom of enterprise on the high seas or that of the ensuring of the maximum sustained productivity. Mr. CHIBA’s statement is as in Annex 1. The Japanese delegate stressed that an agreement would be absolutely necessary where measures were to be taken to ensure, together with other countries, the maximum sustained productivity and that the measures to be taken for this end should be taken on an equal basis for all the countries concerned.
b. Mr. YIM asked, whether or not the concerned parties should adopt the same fishing gear and methods as well as fishing seasons, since, according to the Japanese opinion, conservation measures should be taken on an equal footing.
Mr. CHIBA answered that taking conservation measures on an equal footing meant that no unilateral obligations should be imposed on any party concerned, and that as for matters which were not agreed upon, complete freedom should prevail. Mr. YIM said he regretted having to disagree with the Japanese delegate.
c. Then, proceeding to the Preamble of the draft Agreement, the Korean delegate asked if the words
“Acting in the light of their rights under the principles of …”
could not be read
“Acting in the light of their rights recognized under the principles of …”
Mr. CHIBA said that the meaning was the same.
d. Pointing out the phrase “the fishery resources wherein the two Contracting Parties have common interest”, Mr. YIM asked whether or not these fishery resources included those wherein only one of the contracting parties has interest. Mr. CHIBA replied that it was not intended to include such resources in this draft agreement.

It was agreed that the next session would be held on February 28th, 1952, at two o’clock p.m. in room No. 411, Ministry of Foreign Affairs.
