Summary Record of the Fourth Session of the Basic Relations Committee
1. Date, time and place:
March 5th (Wednesday), 1952 10:30-11:30 a.m.

3. Proceedings:
(A) Mr. YU delivered to the Japanese Delegates the “Draft Basic Treaty between the Republic of Korea and Japan” as per Annex, and made the following explanations on the Draft:
1. The name of the Treaty
This Conference would be deemed as a peace conference in fact, and the term of the “Basic Treaty” was used instead of “Treaty of Amite”.
2. Preamble
a) last Paragraph
It was described in the last Paragraph, Preamble of the Japanese Draft, to “maintain permanent peace and firm and enduring friendship and economic relationship”. However, the Korean side considered that it was not necessary to specify “economic relationship” since true friendship was the friendship which involved not only economic one, but political and cultural ones.
b) 2nd Paragraph
Korean side understood that the main purposes of this Conference were to solve all the pending problems before staring to settle the problems arising from new relationship, and only the word of “the various pending problems between them” was used.
3. Article 1
Article 1 of the Korean Draft means the readiness of the Korean Government to recognize japan as a sovereign and independent nation as soon as Japan becomes a full sovereign country with the coming into force of the Peace Treaty.
4. Article 2
“This Article is a simplified article corresponding to Article 1 of the Japanese Draft which consisted of the words”, “inaccordance with the purposes and principles of the Charter of the United Nations” and “by such means as befit the good neighborly relations”. However, the Korean side struck out the said words, for the meaning of the words was too obvious to be repeated.
5. Article 3
The purpose of this provision is to confirm that all Treaties and Agreements between the two countries concluded on and before August 22, 1910 were null and void.
6. Article 4
This Article is similar to Article 2 of the Japanese Draft.
7. Article 5
The commerce and navigation clauses were provided in this Article as in Article 12 of the Peace Treaty because Korea is entitled by Article 21 of the said Treaty to the benefits of the said Article.
8. Article 6
When the agreements were made at the Committee on the legal status of Korean residents in Japan, the conclusions for the said agreement would be described in this Article.
9. Article 7
This Article would be provided to the same effect as mentioned above.
10. Article 8
The provision of this Article would be the same provision as described in Article 4, (c) of the Peace Treaty because Korea is entitled by Article 21 of the said Treaty to the benefits of the said Article.
11. Article 9
This Article would be made by the same purport as mentioned on Article 6.
12. Article 10
This Article is the provision as to the ratification and the coming into force of this Treaty. This Article was simplified compared with the Japanese Draft.
(B) It was agreed by both sides that the “Draft Basic Treaty between the Republic of Korea and Japan” presented by the Korean Delegation was formally submitted by the Korean side and was to be discussed by both sides and that the Draft would be deemed to be a corresponding Draft to the Japanese Draft.
(C)
(1) Next session
It was agreed that the next (fifth) session would be held on March 7 (Friday) at ten o’clock in Room No. 419 of the Japanese Ministry of Foreign Affairs.
(2) Press Release
It was agreed that the prese release should be that the Korean Draft Treaty on the Basic Relationship corresponding to the Japanese Draft was submitted by the Korean side.

Draft Basic Treaty between the Republic of Korea and Japan
Whereas the Republic of Korea and Japan are resolved to respect each other’s political independence and territorial integrity and to maintain permanent peace and firm and enduring friendship between the two countries; and
Whereas the two countries recognize that the prompt solution of the various pending problems between them in a spirit of concord and in accordance with the principles of justice and equity will contribute toward the attainment of the aforementioned Objectives;
The two countries have therefore determined to conclude the present Basic Treaty, and have accordingly appointed their respective Plenipotentiaries;
The Government of the Republic of Korea
The Government of Japan
Who, after presentation of their respective full powers found in good and due form, have agreed on the following provisions:
 
Article I
The Republic of Korea recognizes Japan as a sovereign and independent nation.
 
Article II
The Republic of Korea and japan shall cooperate in a friendly manner toward promoting their common welfare and contributing to the maintenance of peace in East Asia and in the world.
 
Article III
The Republic of Korea and Japan confirm that all treaties or agreements concluded between the Government of the Empire of Korea and the Government of Imperial Japan on and before August 22, 1910 are null and void.
 
Article IV
The Republic of Korea and Japan shall establish diplomatic and consular relations with each others as soon as possible,
 
Article V
(a) The Republic of Korea and Japan shall enter as soon as possible into negotiations for the conclusion of a treaty of commerce and navigation in order to place their trading, maritime and other commercial relations on stable and friendly foundation.
(b) Pending the conclusion of the relevant treaty, Japan will, during a period of four years from the first coming into force of the present Treaty
(1) accord to the Republic of Korea, its nationals, products and vessels
(i) most-favored-nation treatment with respect to customs duties, charges, restrictions and other regulations on or in connection with the importation and exportation of goods;
(ii) national treatment with respect to shipping, navigation and imported goods, and with respect to natural and juridical persons and their interests --- such treatment to include all matters pertaining to the levying and collection of taxes, access to the courts, the making and performance of contracts, rights to property, participation in juridical entities constituted under Japanese law, andgenerally the conduct of all kinds of business and professional activities;
(2) ensure that external purchases and sales of Japanese state trading enterprises shall be based solely on commercial considerations.
(c) In respect to any matter, however, Japan shall be obliged to accord to the Republic of Korea national treatment, or most-favored-nation treatment, only to the extent that the Republic of Korea accords Japan national treatment or most-favored-nation treatment, as the case may be, in respect of the same matter.
(d) In the application of this Article, a discriminatory measure shall not be considered to derogate from the grant of national or most-favored-nation treatment, as the case may be, if such measure is based on an exception customarily provided for in the commercial treaties of the party applying it, or on the need to safeguard that party’s external financial position or balance of payments, or on the need to maintain its essential security interests, and provided such measure is proportionate to the circumstances and not applied in an arbitrary or unreasonable manner.
 
Article VI
(When satisfactory agreement is reached by the committee on Nationality and Treatment of Korean Residents in Japan, then it will be provided in this Article.)
 
Article VII
(When satisfactory agreements are reached by the Committees on Claims and Vessels, than they will be provided in this Article.)
 
Article VIII
Submarine cables connecting the territories of the Republic of Korea and Japan shall be eoually divided, Korea retaining the Korean terminal and adjoining half of the cable, and Japan the remainder of the cable and connecting terminal facilities.
 
Article IX
(When satisfactory agreement is reached by the Committee on Fisheries, then it will be provided in this Article.)
 
Article X
The present Treaty shall be ratified by the Contracting Parties in accordance with their respective constitutional procedures. The instruments of ratification shall be exchanged at Tokyo, The present Treaty shall come into force on the date of the exchange of ratification.
In witness Whereof the undersigned Plenipotentiaries have signed the present Treaty.
Done at Tokyo this day of 1952, in duplicate in the Korean, Japanese and English Languages, each taxi being equally authentic.
 
대한민국과 일본국 간의 기본조약(안)
(1952. 3. 5)
 
대한민국일본국은 상호로 타방(他邦) 당사국의 정치적 독립과 영토보전을 존중하고, 또 양국 간에 항구(恒久) 평화와 공고하고 영속적인 우호관계를 유지할 것을 결의하고, 또 양국은 양국 간에 개재하는 각종 현안을 화협의 정신에 의하여 또 정의와 형평의 원칙을 따라 신속하게 해결하는 것이 전기 목적을 위하여 기여하는 바임 인정하므로 인하여 양국은 이 조약을 체결하기로 결정하고 그를 위하여 다음과 같이 각국의 전권위임을 임명하였다.

이들 전권위임은 그 전권 위임장을 제출하여 그것이 양호 타당함을 인정한 후 다음 규정을 협정하였다
 
제1조
대한민국일본국은 상호로 각기 독립주권국가임을 승인한다.
 
제2조
대한민국일본국은 양국의 공통 복지를 증진하고 동아(東亞) 및 세계의 평화유지에 기여하기 위하여 우호적으로 협력한다.
 
제3조
대한민국일본국은 1910년 8월 22일 이전에 구 대한제국일본국 간에 체결된 모든 조약이 무효임을 확인한다.
 
제4조
대한민국일본국은 가능한 한 속히 외교 및 영사 관계를 설정하기로 한다.
 
제5조
A. 대한민국일본국은 무역, 해운, 기타의 통상 관계를 안정되고 우호적인 기초 위에 두기 위하여 통상항해조약을 체결하기 위한 교섭을 가능한 한 속히 개시하기로 한다.
B. 해당 조약이 체결되기까지 일본국은 본 조약의 최초의 효력 발생 후 4년 간
(1) 대한민국 그 국민, 산품 및 선박에 대하여 다음의 대우를 공여한다.
(i) 화물의 수출입에 대한, 또는 이에 관련하는 관세, 과금, 제한 기타의 규제에 관한 최혜국 대우
(ii) 해운, 항해 및 수입화물에 관한 내국민 대우 및 자연인, 법인 및 그들의 이익에 관한 내국민 대우. 이 대우는 세금의 부과와 징수, 재(裁)를 받는 일, 계약의 체결과 이행, 재산권, 일본국 법률에 의하여 조직된 법인에의 참가 및 일반적으로 모든 종류 의 사업활동과 직업활동의 수행에 관한 모든 사항을 포함하는 것으로 한다.
(2) 일본국의 국영 상(商)기업의 국외에 있어서의 매매가 상업적 고려에만 기초를 둘 것을 확보한다.
C. 그러나 어떠한 사항에 관하여도 일본국대한민국이 당해 사항에 관하여 각기 내국민 대우 또는 최혜국 대우를 일본에 공여하는 제도에 있어서만, 대한민국에 내국민 대우 또는 최혜국 대우를 공여하는 의무를 지는 것으로 한다.
D. 본 조를 적용함에 있어서는, 당사국의 통상조약에 관례적으로 규정되어 있는 예외에 기초를 두고 행하는 차별적 조치 그 당사국의 대외적 재정, 상태 또는 국제수지를 보호할 필요에 기초를 둔 차별적 조치, 또는 중대한 안전상의 이익을 유지할 필요에 기초를 둔 차별적 조치는 그것이 사태에 상응하고, 또 자의적이거나 불합리한 방법으로 적용되지 아니하는 한, 각기 내국민 대우 또는 최혜국 대우의 허여를 해(害)하는 것으로 인정하여서는 아니된다.
 
제6조
이 조약은 당사국에 의하여 각자의 헌법상의 절차를 따라 비준되어야 한다. 비준서는 일본국 도쿄에서 교환하기로 한다.
이 조약은 비준서 교환일로부터 실시된다.
이상의 증거로서 하명(下名)의 전권위임은 이 조약에 서명하였다.
1952년 월 일에 도쿄에서 다 같이 정문인 한국어, 일본어 및 영어로 2통을 작성하였다.
