Section A

Officers and duties
1. The officers of the Council shall consist of a President, a Vice President, a Secretary, and a Treasurer, who shall be chosen by the Council and shall hold office lot, and during, the current calendar year, provided that a vacancy in any office, caused by death, resignation or otherwise, may be filled by the Council at any regular meeting after such vacancy occurs.
 
2. a. It shall be the duty of the President, or, in his absence, of the Vice President, to preside at all the meetings of the Council, and to determine all questions deciding under the rules appertaining to the deliberations of the Council, subject to an appeal from his decision to the Council in session, but his decision must stand unless overruled by a vote of two thirds of the members present. In case of the absence of both the President and the Vice President, the Council may select one of its members to acted temporary President in conformity with the provision of these rule.
b. It shall be the duty of the secretary to keep a record of all proceedings of the Council in a substantial bound book, to be provided by the Council for that purpose, to draw all orders upon the treasurer by the order of the Council, to serve notices upon members of the Council and to do other duties in the way of correspondence, reading the minutes of meetings of the Council, motions, resolutions, or other papers introduced at a meeting of the Council, as may be requested by the Council.
c. It shall be the duty of the treasurer to receive, safely keep, and account for, all monies of the Municipality, and to pay the same out upon the order of the secretary, countersigned by the president and sealed with the official seal of the Municipality, in every instance taking a proper receipt therefor to be preserved and presented by him as a voucher in making settlement with the Council or with its proper officers or representatives as may be by these rules provided. He shall, in all requests, conform to the others of the Council with reference to depositing at preserving the funds of the municipality, and upon failure in this request will render himself liable to the municipality for any less resulting from such failure, notwithstanding the provisions of Article 5 of these Rules.
3. The council may appoint an Executive Committee of these members of its, who, under the direction and subject to the approval of the Council, shall have a general supervisory control of streets, drains, lanyard, licenses, bridges, nuisances, selection of servants and policemen, and sanitary matters coming within the scope of the Rules and Bye Laws of the Council.
 
4. the Council of itself or by its authorized members, may upon time to time appoint such officers and servants as may be secretary for Municipal proposed in accordance with the provisions of the Land Regulations for the Foreign settlement of "Chemulpo", and may fix the salaries, wages, and allowances of such officers and servants, and may make rules and regulations for the government of such officers and servants, and may discontinue or remove any of them, from time to time, as it shall think fit.
 
5. No matter or thing done, or contract entered into, by the Council, not any matter or thing alone by any member there of, or by the secretary, treasurer, or other officer or person whomsoever acting under the direction of the Council, shall, if the matter or thing were done, or the contract entered into bona fide for Municipal purposes as defined by the Land Regulation aforesaid, subject them, or any of them, personally to any action, liability on claim whatsoever, and any expense properly and with due authority incurred by the Council, its members, secretary, treasurer, or other officer or person acting as last aforesaid, shall be bone and paid out of the municipal funds.
 

Section B.

Rules regulating the deliberations of the Council.
1. The English language shall be used for the proceedings of the meetings and recording its minutes. However members may use another language provided a sufficient interpretation shall be given in the English language.
 
2. The order of business of all meetings of the Municipal Council shall be a follow:
a. To record the names of members present.
b. Reading of the minutes of the last meeting, and the question of these approval.
c. Unfinished business of the last meeting.
d. Committee Reports.
e. Miscellaneous business.
 
3. A member who wished to speak shall rise in his place and address the president, when, having received permission, he may proceed. In the event of more than one member rising simultaneously. The president shall decide which is entitled to be first heard. The subject of discussion must not be deviated from. The president shall be the judge of all questions of order, but a member called to order may explain and appeal to the Council.
 
4. Motions must, if requested by the president, be written out, and having been signed by the mover, be read by the secretary to the meeting, and handed up to the president, who shall then state the question as open for debate, and until it is disposed of and the result announced, no other motion shall be in order, except:
a. to amend
b. to postpone to a day certain
c. to refer to a committee
d. to postpone indefinitely
e. to adjourn, which, being always in order is to be decided at once by vote, without debate.
 
5. When a motion under debate is susceptible of division into two or more branches, it may, at the request of a member, be divided, and the question, when recalled, taken in its separate parts.
 
6. The president shall have only one vote, as other members; and no motion shall prevail unless it shall receive a majority of all the votes cost.
 
7. The Council shall regulate the time of its own meetings, provided that at least six meetings shall be held in each year.
 
8. The president, at the request of three or more members shall call an extraordinary meeting, giving one weeks notice thereof.
 
9. The Rules for regulating the deliberations of the Council may be amended, added to, or altered, by a majority of members present of a regular meeting after thirty days notice of the intended change.
10. The Rules for regulating the deliberations of the Council may be temporarily suspended by a two thirds vote.
 
11. A Quorum to transect business shall consist of not less than five members, but a less number may adjourn from day to day.
 
12. The circular convening a meeting is to be issued at least one week beforehand and is to mention any important business to be brought before the meeting.
 

Section C.

Appropriation and expenditure of Municipal Funds.
1. no money belonging to the municipality shall be expended until after an appropriation of the same by the municipal Council for the purpose for which it is to be expended.
 
2. At the last regular meeting of the council in each year appropriations shall be made of the funds of the municipality to defray the current expenses of the same for the following year. Provided that when it is necessary at such meeting the Council may sit from day to day until the duties enumerated herein may be fully completed, and provided that the appropriation for the year 1889 shall be made on as before the 1st day of july of that year.
 
3. Appropriations of the Funds of the municipality for the necessary use and benefit of the municipal residents may be made at any meeting of the Council, provided that a majority of the whole Council consent thereto and that notice be given to the members of the Council twenty days before week meeting of the nature of the business to come at that time before the Council.
The foregoing Rules shall come into force immediately after their approval by the Representatives of the Treaty Powers in foul.
 
On pursuance of the provisions of paragraph 6 of the chemulpo Foreign settlement land regulations, it is agreed between the foreign authorities therein refered to that the three members of the municipal Council of Chemulpo, to be chosen from the registered landholders of the foreign settlement, shall be elected according to the following rules, namely:
 
1. The three members shall, except as herein after provided, continue in office during a term of three good, each year being reckoned as beginning on the first day of December.
 
2. Only registered landholders in accordance with the provision of the Chemulpo Foreign Settlement Land Regulation are eligible for election.
 
3. Each such registered landholder as aforesaid shall be entitled to one vote, but in no case shall voting by proxy be allowed.
 
4. On Wednesday the 5th day of december 1888 there shall be an election of three members, one of whom shall retire in the 31 of December 1889, one on the 31 of December 1890, and the third on the 31 of December 1891. The elected member who has polled the smallest number of votes shall retire first, the one who has polled the next largest number of vote shall retire next, and the member, who gas polled the largest number of vote shall retire best. In the case of equality of votes, on if only three candidates are nominated the order of retirement shall be determined by lot amongst the three elected candidates in such manner as may be agreed upon by them.
 
5. In order to fill up the vacancy caused by the retirement of a member at the termination of his term of office on election shall be held, on the first wednesday in the month of December in each year, of a member to serve for the three years then next ensuing, which shall be conducted in the mode herein provided.
 
6. The elections shall be conducted under the direction of the official member of the municipal Council, and in the presence of at least three of the said official members, who shall set as judge three of. and, after the poll are closed, shall count the vote and shall declare the candidate having the largest number of votes to be duly elected.
7. The voting shall be by ballet. Each votes of the election shall present to the judge there of a piece of paper with the name, or named, of the candidate, or candidates, of his choice written or printed thereon. There ballets, at the time they are received, shall be deposited by the said judges in a closed box to be provided for that purpose, and there report till the time fired for the alone of the poll, when they shall be taken out to be counted.
 
8. The office of a member shall be vacated by his death, or resignation, or by his ceasing, during the term of his tenure of office, to be a registered landholder.
when a vacancy occurs from any of these cause, the remaining members of the Council may elect any qualified person to fill the office till the next yearly election, when the vacancy shall be filled up in accordance with these Rules. The person these elected shall retire at the termination of the term of office of the member in where stead he shall have been elected.
